1) The Service
Heruno is a personal Time Capsule app for saving thoughts, feelings, memories, and goals, and opening them on
an unlock date you choose. You can write entries, add photos from your library or camera, set a simple emotion
level, seal capsules with tokens, and browse locked, upcoming, and opened items on your timeline. Growth
provides at-a-glance stats and trends over time.
Capsule content you create is intended to stay on your iPhone for your personal use. Other parts of the app may
involve information handled according to our Privacy Policy.
License. Subject to these Terms, Heruno grants you a limited, non-exclusive, non-transferable, revocable license to
install and use the App for your personal, non-commercial use on devices you own or control.
2) Eligibility
You must be at least 17 years old to use the Services. By using the Services, you represent and warrant that you meet this requirement.
3) Accounts
You may need an account to use certain features. You agree to provide accurate information and keep it updated.
You are responsible for activity on your account and for maintaining the confidentiality of your credentials.
4) Your Content
Ownership. You retain ownership of the content you create and store in the App ("User Content").
License to operate the Services. You grant Heruno a limited, non-exclusive, worldwide license to process User Content only
as necessary to operate, provide, and improve the Services and to comply with law. This license ends when your User Content is deleted from the Services,
except where continued storage is required for legal, security, or backup reasons.
Responsibility. You are responsible for your User Content and agree not to upload, create, or share content that is illegal,
infringing, harmful, or violates the rights of others.
5) AI Guide (Optional) — Not Professional Advice
AI Guide may generate a short reflection for personal context. AI Guide outputs are for informational and personal reflection purposes only
and are not medical, psychological, legal, financial, or other professional advice. Do not rely on AI Guide as a substitute for professional advice.
If you choose to use AI Guide, the text and/or images you submit may be processed on servers controlled by Heruno Team to generate the output.
Data handling for AI Guide is described in our Privacy Policy.
6) Tokens, Virtual Items, and In-App Purchases
Some actions require tokens (for example, sealing a capsule or using AI Guide).
- Virtual items: tokens are virtual items for use within the App, have no cash value, and are not transferable.
- Visibility: token balances and options are shown within the App.
- Payments: if you purchase tokens or related items, payments are processed by the App Store provider (e.g., Apple). We do not collect or store your full payment card details.
- Refunds: refunds, if any, are handled according to applicable law and the App Store provider’s rules.
7) Privacy
Your use of the Services is also subject to our Privacy Policy.
App Store / Apple terms (if applicable). If you access the App through the Apple App Store, you acknowledge that Apple
is not a party to these Terms and is not responsible for the App or its content; Apple has no obligation to furnish maintenance or
support services for the App (to the extent permitted by law); and Apple and its subsidiaries are third-party beneficiaries of these
Terms and may enforce these Terms against you.
8) Prohibited Conduct
- Reverse engineer, decompile, or attempt to extract source code from the Services, except where permitted by law.
- Interfere with or disrupt the Services, including attempting to bypass security or access controls.
- Use the Services for unlawful, harmful, or abusive purposes.
- Misuse tokens or attempt fraudulent transactions.
9) Termination
We may suspend or terminate your access to the Services if you violate these Terms, if required by law, or to protect the security of the Services.
You may stop using the Services at any time.
10) Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERUNO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED,
INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE
UNINTERRUPTED, ERROR-FREE, OR SECURE.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERUNO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS
OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERUNO’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF
(A) THE AMOUNT YOU PAID TO HERUNO (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12) Governing Law
These Terms are governed by the laws of Heruno Team’s principal place of business, without regard to conflict of law principles,
except where local law requires otherwise.
13) Dispute Resolution — Binding Arbitration
Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be resolved by binding
arbitration rather than in court. The arbitration will be conducted on an individual basis. You and Heruno waive any right to a jury trial and to participate
in a class action or class-wide arbitration to the fullest extent permitted by law.
Nothing in this section prevents either party from seeking injunctive or equitable relief for unauthorized use of intellectual property or misuse of the Services.
14) Changes to These Terms
We may update these Terms from time to time. We will update the Effective Date and, where required, provide notice.
Your continued use of the Services after changes become effective means you accept the updated Terms.
